Ogden man shot by police released from hospital, booked into jail

A man shot and wounded by police in Ogden last week has been charged with felony assault and weapons charges, court records show.

Emmanuel Isaac Montoya was shot on May 20 by a member of the Ogden Metro Gang Unit as he tried to flee police, who had been watching for him outside a residence in the 3100 block of Grant Avenue.

Montoya, 31, whose name was initially withheld, was wanted in connection with an alleged assault, Ogden police said in a Wednesday news release.

The release describes Montoya as a "documented Ogden Trece gang member."

Montoya was hospitalized after the shooting, but was released and booked into the Weber County Jail on Wednesday, police said.

Prosecutors filed two cases against Montoya this week in 2nd District Court. The charges stem from incidents on May 18 and May 20 and include counts of third-degree felony failure to respond to an officer's signal to stop, aggravated assaults and possession of a firearm by a restricted person.

In both instances, Montoya allegedly fled from officers, court papers say. In the May 20 incident, Montoya also allegedly brandished a handgun at another man, who later told police he feared for his life, the records show.

Court papers say Montoya is a known gang member who uses the moniker "Insane" and has past criminal convictions for drug possession.

As of Thursday, court records show no hearings have been scheduled in either case.

The name of the officer involved in the shooting has not been released, although Ogden police have said he is a 10-year veteran of the department.
