The Utah Court of Appeals sided with the police in a ruling handed down Friday that upholds the controversial practice known as stop and frisk.
Bryant Robert Mitchell brought the case to the appeals court saying he was wrongfully searched in an Ogden traffic stop last year, FOX 13 reported. Police said Mitchell was acting “upset” and “aggressive," like he was trying to get into a fight.
Mitchell said he gave no indication he was going to be violent.
While the court said it was “a close case," it ruled the officer had “reasonable articulable suspicion to conduct” the stop and frisk.
