A convenience store owner will not be charged after fatally punching a customer during an argument over a soda fountain drink last month in Clearfield.
The Davis County Attorney’s Office determined there was “no reasonable likelihood” that the storeowner would be convicted if he was charged with a crime.
Brandon Stufflebean, 39, of Layton, went into the store at 680 N. Main St. on the afternoon of April 10, where he got into an argument with the store owner about buying a drink, police said.
The store owner punched Stufflebean in the face; not long after that Stufflebean was found unconscious in the parking lot, with a “serious head injury,” police said. He died about a day after that.
According to a statement released by the Davis County Attorney’s office, the decision was made after reviewing video surveillance, witness statements and other evidence: “There is simply insufficient evidence that [the store owner’s] conduct rose to the level of criminal conduct. To the contrary, all evidence points to the conclusion that [his] conduct was legally justified.”
