A 33-year-old Midvale man has been sentenced to prison for up to five years in the 2013 death of his passenger in a traffic accident in South Jordan.

Luis Enrique Tovar, 33, was speeding on a motorcycle on Aug. 10, 2013, on 3200 West near 10950 South when he illegally passed another motorist in the center lane and crashed, according to charges filed in 3rd District Court.

Tovar's passenger, 29-year-old Tara Nicole Sheppick, died at a hospital.

Neither was wearing a helmet, police have said.

Tovar was initially charged with second-degree felony manslaughter. He pleaded guilty in March to a reduced third-degree felony count of manslaughter.

In exchange for his plea, prosecutors dismissed three class C misdemeanors: speeding 58 in a 30 mph zones, failure to observe a no passing zone and driving with the wrong class of license.

Judge Charlene Barlow on Monday sentenced Tovar to prison for zero to five years.
