A former Davis High School teacher accused of having sex with three male students, will have three separate trials, a judge ruled Monday. And there will be a fourth trial to cover additional charges alleging she had sex with one of the students while she was out on bail.

Brianne Altice, 35, will appear in 2nd District Court gain on April 9, at which time Judge Thomas Kay could set trial dates.

Altice, who taught English, is accused of having sexual relationships with the three students beginning in 2013.

The alleged sex with the third student occurred after she was out on bail facing charges for having sex with the first two students.

When a judge learned of that in January 2015, he revoked Altice's bail. She is currently awaiting trial in the Davis County jail.

She is facing a total of 14 felony charges: five counts of first-degree felony rape, two counts of first-degree felony forcible sodomy, three counts of second-degree felony forcible sexual abuse, along with three counts of unlawful sexual activity with a minor and one count of dealing harmful material to a minor, all third-degree felonies.

Defense attorney Ed Brass had asked for the cases of the three teens to be tried separately, arguing in court papers that trying them together would "extremely prejudice" Altice's right to a fair trial.

Earlier this month, one of the students sued the Davis County School District, alleging it was negligent in hiring and retaining Altice, and seeking at least $674,000. The lawsuit says the district once reprimanded Altice after seeing photographs of her having "inappropriate contact with students," but the district did not terminate her or sufficiently supervise her.
