A Sevier County man is dead and another was behind bars on Monday after a weekend party erupted into a physical fight that ended with gunshots.

County deputies responded to a 911 call of "shots fired" at a residence in Venice at about 12:30 a.m. Sunday, to find David Rioja on the ground and suffering from a single gunshot wound to the chest, Sheriff Nathan Curtis said.

The 36-year-old man, who had hosted a party at his home that night, died at the scene despite the efforts of deputies and paramedics, Curtis said.

At about the same time, police received a second 911 call from another Venice man, William G. Muir, who reported being the victim of an assault.

Police found Muir with obvious facial injuries consistent with a fight and took him to a hospital for treatment, Curtis said.

During questioning, Muir's statements to police led them to believe he had been involved in Rioja's shooting, the sheriff said. Also, Muir's wife told police her husband had left home Saturday night to attend a party and had taken a gun. The gun, a revolver, was later recovered from Muir's home.

It is not clear what triggered the argument between Rioja and Muir, although both are believed to have been drinking alcohol, Curtis said. The pair were not friends, but did have a mutual acquaintance who had invited Muir to Rioja's gathering.

"Somebody got mad," Curtis said. "What tipped it over, we don't know."

Curtis said no one witnessed the shooting.

Rioja's family members, who live in a house on the same property and called 911, could only tell police that they heard yelling just before the shooting, followed by the sound of a car speeding away.

Muir was booked into jail on Sunday and was being held on suspicion of murder, Curtis said.

Formal charges are pending a review by the Sevier County Attorney, he said.
